Are You Informed About the New Law 16?
As of August 14, 2025, important new obligations are in effect for condominium boards in Québec under Loi 16.
Adopted in 2019, Loi 16 aims to improve the management and maintenance of condo buildings. While some measures were implemented earlier, a complementary regulation published on July 30, 2025 has now made the following requirements official:
1. Maintenance Logbook (Carnet d’entretien)
Every condo syndicate must maintain a detailed, regularly updated record of the building’s condition and maintenance history.
2. Reserve Fund Study (Fonds de prévoyance)
A formal study must be carried out to plan the financing of major repairs and necessary replacements over time.
3. Syndicate Certificate (Attestation du syndicat)
Boards must provide a certificate to prospective buyers detailing:
The reserve fund’s financial data.
The maintenance logbook.
Current and planned work.
